Peerspace Social Event Policy

At Peerspace we understand that many of our users set up Bookings in order to host social events, and it is our goal to allow you to do so while at the same time prioritizing the safety of all guests and avoiding damage to the Host's property. The Social Event Policy is a non-exhaustive list intended to help give assurance to all our users that social events will be run in a safe, legal and respectful manner.
This Social Event Policy is part of, and uses words and phrases defined in, the Peerspace Services Agreement. In the event of any express conflict between the terms of the Peerspace Services Agreement and this Social Event Policy, the terms of this Social Event Policy shall prevail. If you have any questions about the Social Event Policy or if you believe that a user has violated this Social Event Policy, please contact us.
You must agree to this Social Event Policy, as part of the Peerspace Services Agreement, to use the Platform and Services. Please read them carefully and only use the Platform or Services if you agree to abide by them.
VIOLATIONS OF THE SOCIAL EVENT POLICY
We take violations of the Social Event Policy seriously and have a zero-tolerance policy with respect to violations. PEERSPACE MAY TAKE LEGAL ACTION AGAINST HOSTS OR GUESTS THAT ATTEMPT TO CIRCUMVENT THIS SOCIAL EVENT POLICY. In the event of ongoing or serious violations, we reserve the right to take all action which we deem necessary, including suspending or permanently terminating Accounts, canceling Bookings without refund to the Guest, assessing fines, and taking any other actions permitted or required by law, including cooperating with local authorities in enforcement and prosecution matters. We may also moderate, remove, or edit any Content that violates this Social Event Policy or if we believe it adversely affects the integrity of Peerspace or other users.
SOCIAL EVENTS
This Social Event Policy applies to the use of any Space for a planned social gathering, (a “Social Event”). This may include, but is not limited to, any event where alcohol is sold, tickets are distributed, or where there is a charge for entry. Any such events shall be referred to herein as a “Social Event” and all Hosts and Guests must comply and enforce this Social Event Policy for all Social Events. A non-exhaustive list of example gathering occasions that may be classified as Social Events (as determined solely by Peerspace) include audio recordings, dance classes, fitness classes, yoga classes, brunch, cooking classes, dinners, food events, tastings, cocktail parties, formal events, fundraisers, holiday parties, receptions, weddings, launch events, networking, pop ups, birthday parties, ceremonies, marriage proposals, parties, reunions, art shows, fashion shows, listening parties, performances, rehearsals, baby showers, bridal showers, gender reveal parties, engagement celebrations, concerts, showcases, anniversaries, music release events, etc.
COMPLIANCE WITH APPLICABLE LAWS
Guests shall be responsible, at their sole cost and expense, for making sure that their Social Event complies with all applicable laws, including zoning, municipal and other laws in effect and applicable to the Space. This includes (i) determining if any event permit is required and, if applicable, obtaining such permit prior to the Social Event, (ii) complying with applicable laws with respect to signage and advertising for the Social Event (and all signage must be approved by the Host at least 48 hours prior to the Social Event), and (iii) if food or alcohol are being served at your Social Event, ensuring that you comply with all applicable requirements pertaining thereto.
BOOKING A SPACE FOR A SOCIAL EVENT
If a Guest plans to hold a Social Event at a Space that they book, they must disclose this in their Booking request and provide the requested details relating to the activity being planned, including, without limitation, details on any alcohol being served or sold at the event. This allows Peerspace and the Host to familiarize themselves with the event concept, including confirming compliance with this Social Event Policy. Peerspace maintains the right to review Booking requests at any time to confirm compliance with this Social Event Policy. If Peerspace identifies any potential non-compliance with this Social Event Policy, or requires more information to determine compliance, it shall have the right to request additional details from the Guest and/or to suspend or cancel Bookings.
Guests must receive express written permission from the Host to disclose the address of their booked space on a public forum (i.e. social media, flyer, etc).
Any proposed changes with respect to the previously disclosed details of a Social Event must be submitted through the Platform for approval by the Host at least 48 hours prior to the Social Event with notice to Peerspace here.
SOCIAL EVENTS AT RESIDENCES
All Social Events held at residential Spaces must commence prior to 9:00 pm and end no later than 12:00 am (local time), inclusive of set-up and clean-up time, except for Social Events held at residential Spaces located in France, which are not subject to these timing restrictions.
Additionally, any Social Events where alcohol is sold, tickets are distributed, attendance is by open invitation, there is a charge for entry, live music is played, or that is generally open to the public are prohibited in residential Spaces. Notwithstanding the foregoing, if the Guest is able to obtain proof of valid permits allowing for a Social Event at a residential Space to be held outside such timeframe it may submit such proof to the Peerspace Team for consideration.
Hosts facilitating Social Events in violation of this Social Event Policy, local laws, or condominium or homeowners association restrictions will have their account suspended pending an investigation and may be subject to Fines related to displacement costs incurred for Guests that require rebooking.
SOCIAL EVENTS AT COMMERCIAL SPACES
Social Events at commercial Spaces (which include but are not limited to clubs and bars) shall adhere to the guidelines for hours promulgated by the Host and in any event must comply with applicable law. All Social Events must comply with applicable law and Host requirements, including the acquisition by Guest of any required permits. All Bookings must span the entire length of the Social Event and must include additional time needed for set-up and clean-up. To help ensure the safety of the community, Social Events at certain commercial locations, such as warehouses, must conclude by no later than 12:00 am (local time), inclusive of clean-up time.
EVENT LIABILITY INSURANCE
Obtaining and maintaining primary liability insurance with the proper endorsements that provide coverage as required by applicable Law and for the risks associated with the planned activity is a requirement for all Hosts and Guests undertaking bookings on the Platform. It is essential for all users to familiarize themselves with and adhere to these insurance-related requirements to ensure a safe and secure booking experience for everyone on our platform. This is a mandatory requirement in the U.S. and in any other jurisdiction where an Event is being held and event insurance is available for purchase. The Guest’s insurance policy must be consistent with the details set forth in their booking and include Peerspace and the Host as Additional Insureds.
If required by Peerspace, the Guest and/or Host shall provide proof of valid event insurance of the type and with the limits as designated by Peerspace. If proof of insurance by the Guest is required, you must provide it to the Host and Peerspace by the communicated deadline. Failure to comply with this requirement may result in Peerspace canceling the Booking.
Guests outside of the U.S. who are unable to obtain such insurance because it is not available for purchase must disclose this to the Host at the time of booking. It will be at the Host’s absolute discretion as to whether they accept the booking or not under these circumstances.
Where a Host accepts a booking from an uninsured or underinsured Guest, the Host indemnifies Peerspace against all liabilities, costs, expenses, damages and losses (including but not limited to any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs (calculated on a full indemnity basis) and all other reasonable professional costs and expenses) suffered or incurred by Peerspace arising out of or in connection with the Host accepting such booking from the uninsured or underinsured Guest.
DECORATIONS AND COSMETIC ALTERATIONS
We understand that the right decor can be an integral part of a Social Event. Since the Host will not provide decor unless noted in the Booking or arranged through a Host Add-On, we encourage the Guest to bring any decorations they may need for their Social Event or to secure rented equipment from an outside company. When Booking a Space for a Social Event, it is the Guest’s obligation to independently determine what the Space is appropriate for and that it can support the planned Social Event and to plan and install any decorations needed for the Social Event. Any decorations used for a Social Event may not be affixed (including by means of tape, nails, staple guns, pushpins or other potentially damaging fasteners) to any surface of the Space and no physical alterations of the Space (including painting, erecting of permanent or semi-permanent alterations or the installation of any fixtures) may be done without the express written consent of the Host. To ensure safety and to guard against property damage, and/or personal injury, decorations may not obstruct entrances and exits and must allow for emergency egress at all times. Decorations cannot cover emergency signs, fire lanes or exits, or be posted in elevators or stairwells and must be constructed of non-flammable materials.
SET UP, GARBAGE DISPOSAL, AND BUILDING DAMAGE AND CLEANING COSTS
Set Up and Clean Up - At the conclusion of the Social Event, the Guest shall be responsible for removing all decorations, material, equipment and debris and for repairing any damage to the Space arising out of the Social Event. Prior to the end of the time scheduled for the Social Event, the Guest shall inspect the Space to confirm their compliance with this Social Event Policy. Failure to do so may result in liability for alleged damage claims.
Garbage/Recycling/Organics Disposal - Garbage, recycling and organic waste are to be placed inside the designated and appropriate garbage, recycling and organic waste containers. Unless communicated otherwise to you directly by the Host, Guests must ensure that the garbage is placed in plastic bags and securely tied before placing it in the trash bins, must break down any boxes and rinse out recyclable containers prior to placing them in recycling bins and must ensure that any organic waste is separated as required by applicable law. If trash will not fit inside the designated containers, it shall be the Guest’s responsibility to properly dispose of such excess trash. Any trash left behind that will not fit in the available containers may result in additional charges to the Guest. No volatile or highly inflammable materials shall be deposited in the chutes, trash rooms, or trash containers. The Guest must also follow additional garbage disposal requirements provided by the Host.
Building Damage and Cleaning Costs - Within 72 hours after the end of a Booking, the Host shall notify Peerspace if they find any damage to the Space or if they have incurred (or will incur) additional clean up costs as a result of a Guest or Attendees’ violation of these policies. This includes damage caused by Attendees and vendors. Guests acknowledge that they shall be liable for any such costs, which shall be deemed an Additional Fee, as detailed in the Peerspace Services Agreement.
SMOKING
Guests must adhere to, and cause Attendees to adhere to, all rules set forth by the Host regarding smoking (including through the use of e-cigarettes and vaping devices). Guests acknowledge that they may be liable for fines and/or fees for damages as a result of any such violation, including fees or fines imposed by Hosts, which costs shall be deemed an Additional Fee, as detailed in the Peerspace Services Agreement.
DRUG USE
It is prohibited to grow, sell, produce, cultivate, distribute, or use any illegal or restricted drugs or other controlled substances (which, for purposes of this Social Event Policy, shall include any and all cannabis products) in any booked Space, except for the use of such substances as prescribed by a physician for a medical condition and as approved by the Host prior to the Social Event start time.
ALCOHOL USE
If alcohol is to be served at a Social Event, this must be disclosed in the Booking request, and the Guest requesting the Booking must be of legal drinking age in the jurisdiction where the event will be held (i.e. 21 years of age or older for Bookings made in the United States, 19 years of age or older for Bookings made in most provinces or territories in Canada and 18 years of age or older for Bookings made in France, Germany, Spain, the UK and Australia). By submitting a Booking request for a Social Event where alcohol is to be served, Guests shall be deemed to have acknowledged, represented and affirmed that they are of legal drinking age in the jurisdiction in which the Social Event takes place. Guests agree that serving of alcohol is in compliance with the appropriate governmental liquor authority.
All alcohol served at a Social Event shall be for personal consumption and not for resale. Guests agree to take reasonable steps to enforce and comply with local, provincial and federal laws and regulations governing the use of alcohol. Neither the Guest, nor any of their vendors, shall provide alcohol to persons under the legal drinking age in the jurisdiction of the Social Event, and Guest shall confirm the legal age of consumption for all Attendees and follow the rules and regulations of local provincial authorities and guidelines. If local regulations require the serving of food or other non-alcoholic beverages at any event serving alcohol, Guests agree to fully comply with any such requirements.
In addition to the rules set forth in this Social Event Policy, Guest and Host acknowledge and agree to abide by all provisions of the Peerspace Services Agreement relating to alcoholic beverages.
We reserve the right to report any violations of this Social Event Policy to the appropriate authorities for prosecution to the fullest extent allowable by law. Each Guest and Host hereby agree to indemnify and/or reimburse Peerspace for all costs, expenses (including legal fees) and damages we may suffer or incur as a result of any violation by you of this Social Event Policy.
CONDUCT
You shall comply with the Community Guidelines in connection with any Social Event, including respecting the rights of the occupants of the Space and its neighbors, and you agree not to disturb any of them unreasonably. Any abusive, disorderly, violent or harassing conduct by a host, guest, or an attendee, including but not limited to foul language, discriminatory or sexually explicit language made toward others is prohibited. Likewise, vandalism of any kind by you or an attendee on or to the Space is prohibited and Peerspace reserves the right to pursue or cooperate in any legal action related to the misconduct or vandalism surrounding a Booking.
ELECTRICAL AND ELECTRONIC EQUIPMENT USE
All electrical or electronic equipment of any kind or nature installed or used at a Space shall comply fully with all rules, regulations, requirements or recommendations of the Host and the public authorities having jurisdiction over the Space. Guests shall be liable for any damage or injury caused by any electrical or electronic equipment installed or used by them.
SAFETY STANDARDS
Safety is of the utmost concern at any Social Event. Your cooperation in maintaining a safe environment is crucial for the success of the Social Event and the well-being of all participants in the Social Event. As such, you shall, at all times, conduct your activities in a safe and careful manner, with full regard to public safety, and shall observe and abide by all relevant applicable laws (including but not limited to the Americans with Disabilities Act for Bookings in the United States, the provincial accessibility legislation for Bookings in Canada the Equality Act 2010 in the UK and the Disability Discrimination Act 1992 (Cth) in Australia.), ordinances, rules, regulations and requests by duly authorized governmental agencies having jurisdiction over the Space.
In the event of fire, smoke or suspected criminal activity involving imminent harm, you should immediately call 911 (or 999 in the UK) and thereafter also alert the Host and Peerspace.
LOST OR STOLEN PROPERTY
Peerspace shall not be responsible for losses by Guest, Host or any Attendees due to theft, damage to, or disappearance of equipment or other personal property, it being specifically acknowledged that such equipment and property is not under the care, custody, or control of Peerspace. The Host is under no obligation to provide any security measures for the Social Event, this being the Guest’s obligation. We recommend that Guests consider obtaining personal property insurance if not already included in their existing insurance to protect against any damage to or loss of their personal items during a Social Event.
CANCELLATION
We shall have the right, in our sole and absolute discretion, to cancel a Booking at any time pursuant to our Cancellation Policy.
INDEMNITY AND RELEASE
You acknowledge that the indemnity provisions set forth in the Peerspace Services Agreement shall apply to any Social Event and any violation of this Social Event Policy.
Guest further acknowledges and understands that, to the fullest extent allowed by law, they are using the Space at their own risk. Host acknowledges and understands that, to the fullest extent allowed by law, they are allowing for the use of their Space at their own risk. Except as otherwise provided by law, Peerspace shall not be liable, and you expressly waive any claim of liability for personal or property injury or damages, which occur to you or any Attendee at the Space and/or during a Social Event. This waiver includes, but is not limited to any loss, damage or destruction of the personal property of you or any Attendees and is intended to be a complete release of any responsibility for personal injury and/or property damage sustained by you or any Attendees resulting from use of the Space.
COVID-19 SAFETY PROTOCOLS
When planning a Social Event, Guests must comply with all rules, guidelines and applicable law, including local mandates, pertaining to COVID-19 public health mandates. This includes, but is not limited to, abiding by applicable density requirements, social distancing requirements, limitations on public gatherings, wearing of masks, the posting of signs and messages for attendees and other protocols set by the key health protection agency and local authorized bodies in the jurisdiction where the Space is located. It is the Guest’s responsibility to determine the applicable protocols and implement them accordingly.
